Terms of Service

These Terms of Service (“Terms”) govern your use of Fabtales (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information and is part of these Terms.

You must be at least 18 years old (or the age of majority where you live) to create an account. Fabtales is designed for parents and guardians. If you provide information or photos about a child, you represent that you are that child’s parent or legal guardian, or have authority to do so.

You are responsible for activity under your account and for keeping access to your sign-in method secure. Provide accurate information and notify us promptly of any unauthorized use.

You retain ownership of photos and other materials you upload (“Input”). You grant us a limited license to store, process, and use Input solely to provide and maintain the Service (including generating illustrations and stories, and sharing a story when you choose to).

By uploading photos or family details, you represent that:

• You have the rights needed to upload and process them through the Service
• Photos of minors depict your child or a child for whom you are the legal guardian, or you have the parent/guardian’s consent for this use
• Content is appropriate and does not violate law or these Terms

The Service uses AI to create stories, illustrations, and narration (“Output”) from your Input. Subject to these Terms, you may use Output for personal, non-commercial purposes, including viewing, downloading when available, and sharing with family and friends.

Output is provided as-is. AI content may be imperfect, incomplete, or similar to content generated for others. Review stories before sharing them with children. We do not guarantee originality, uninterrupted availability, or fitness for a particular purpose.

We may use Content as needed to operate the Service, enforce these Terms, and comply with law. We do not use your photos or stories to train our own models.

You agree not to:

• Upload photos of people without appropriate rights or consent
• Use the Service for unlawful, harmful, abusive, or fraudulent purposes
• Interfere with or abuse the Service, or attempt unauthorized access
• Resell or commercially exploit Output without our written permission

Zero tolerance for CSAM. Uploading, transmitting, attempting to generate, or otherwise distributing child sexual abuse material through the Service is strictly prohibited. Any such activity will result in immediate account termination, preservation of relevant evidence as required by law, and reporting to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement.

We may suspend or terminate accounts that violate these Terms, and may use automated tools to scan uploads and Output for safety violations.

You agree to indemnify, defend, and hold harmless Fabtales and our officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your Input, your Output, or your violation of these Terms or of any third party’s rights (including privacy, publicity, or intellectual property rights).

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months before the claim, or (b) one hundred U.S. dollars ($100).

You may stop using the Service at any time. To delete your account, contact help@fabtales.app. We may suspend or end access if you breach these Terms or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use after changes means you accept the revised Terms. If you do not agree, stop using the Service.

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where mandatory local law provides otherwise.
